Industrial Law - Unfair dismissal — Worker appealed on the grounds that the Hearing Officer could not have been impartial and that the charge of kiting was not proved — Held that the allegation was clearly proven — Worker dismissed.
Points of Appeal the worker: The worker's side based their appeal on the following points:–

(a) The Hearing Officer could not have been impartial, having regard to the fact that in the many legal opinions sought he had to rely on advice coming from the office of the Attorney General who is at the same time legal counsel for Royal Bank of Canada, the First Pennsylvania Bank.

(b) Having regard to the facts disclosed at the Hearing, the charge of kiting by Miss Carter and one Bedminister was not proved nor kiting by one or the other of the persons named.
