1 having heard arguments as to whether or not the respondent may raise the question of the appointment of members of the Industrial Court on his first submission, we are of the opinion that this submission as it is drafted, is concerned solely, with the question of authority by which the court is established. The question of the appointment of the members of the court is a separate and distinct one which cannot be raised under the first objection.

2 The respondent has asked for an indefinite adjournment in view of the fact that the question of the court's jurisdiction has been referred to the High Court and he states that a judgment is being awaited. No one knows when this judgment will be delivered.
